1. Poinsettia – Euphorbia pulcherrima

Selecta First Class, Inc. Poinsettia varieties are available for self-propagation (stock and tip cuttings).
A Self-Propagation License must be signed and returned to receive stock plants or before taking tip cuttings. Any cuttings taken from these plants must be used for the production of pre-finished / finished / flowering products only (at least grown for 6 weeks in a pot of at least 2.5 inches in diameter). Unlicensed sale of rooted or unrooted cuttings to any other company is strictly prohibited. Propagation of Poinsettias without a Self-Propagation License is strictly prohibited. You may contact ROYALTY Administration International for further information and a license agreement. ROYALTY Administration reserves the right to inspect your premises and plantings at any reasonable time to ensure compliance with the terms of this agreement.

2. The complete listing of Selecta First Class varieties is divided into two categories.

The majority of the varieties that Selecta First Class sells are protected by a Flowering-Only License. This includes patented and patent-applied-for varieties, as well as non-patented varieties. Selecta First Class Pelargonium x hortorum / Peltatum (Geraniums), New Guinea Impatiens, Osteospermum ecklonis / cultivars, and Sutera grandiflora (Bacopa) varieties are available for self-propagation upon completion of a Self-Propagation License.

3. Plant Protection

Selecta First Class varieties are protected by United States Plant Patents, United States Plant Patents Applied For, United States Utility Patents, United States Utility Patents Applied For, Canadian Plant Breeders' Rights, Canadian Plant Breeders' Rights Applied For, and/or the Flowering-Only License Agreement. Many of the varieties are also protected or protection applied for in other countries as well as registered with the Canadian Ornamental Plant Foundation (COPF).

4. Flowering-Only License Agreement

Plants sold, whether grown from rooted or unrooted cuttings, shall be sold only as finished or pre-finished plants. Finished or pre-finished plants are plants grown for at least 6 weeks in a 2-inch (5 cm) pot and reached a size and appearance appropriate for sale. Self-propagation and/or taking tip cuttings as well as the unlicensed sale and transfer of rooted or unrooted cuttings to any other company or individual is strictly prohibited. By opening the box, you signify agreement with the terms and conditions of this Flowering-Only License. A copy of the Flowering-Only License is also available from Royalty Administration International (RAI).

5. Self-Propagation and Licensing Information

Only Selecta First Class Pelargonium x hortorum / Peltatum (Geraniums), New Guinea Impatiens, Osteospermum ecklonis / cultivars, and Sutera grandiflora (Bacopa) varieties are available for self-propagation with tip cuttings (excluding stock). A Self-Propagation License must be signed and returned before taking cuttings. Propagation is strictly prohibited without a Self-Propagation License. Any cuttings taken from these plants must be used for the production of finished or pre-finished plants. Finished or pre-finished plants are plants grown for at least 6 weeks in a 2-inch (5 cm) pot and reached a size and appearance appropriate for sale. Selling or transferring of rooted or unrooted cuttings of these varieties to any party at any time is strictly prohibited. 6. 2-for-1 Policy

For selected products, Selecta First Class ships 2 cuttings each cutting ordered. Because of their natural habit, unrooted cuttings of the selected products are somewhat fine. We require that customers use 2 cuttings per cell/pot. This will utilize the full potential of these varieties and result in a higher quality product. Products included in the 2-for-1 program may change. If cuttings are used/planted only 1 per cell/pot, customers will be required to report it to Royalty Administration International (RAI) and are responsible for the cost of full royalty. Royalty Administration International C.V. (RAI) has been appointed as our agent in North America for the protection of Selecta First Class varieties. RAI reserves the right to inspect premises and plantings at any reasonable time to ensure compliance with the terms of the agreements listed above.

Selecta First Class Image, Tag, and Trademark Policy

All images featuring Selecta First Class products are to be used for promotional materials, including but not limited to point-of-purchase items, tags, advertising, catalogs, fliers, websites, etc. They may not be used without permission from Selecta First Class.

All images loaned by Selecta First Class are copyrighted and are the property of Selecta Klemm GmbH & Co. KG and its subsidiaries. They are loaned to customers for promotional use only. Images may not be sub-licensed or resold. Any unauthorized use is strictly prohibited. All loaned images must be used in connection with the proper trademarks and list the correct variety names and series names in connection with any reproduction.

All labels used for Selecta First Class products must be supplied or approved by Selecta. Labels must include the full commercial name of the product, the term "Propagation is prohibited", must use Selecta-approved images, and all connected trademarks. All custom label layouts and orders must be approved prior to production/reproduction.
